Thucydides History of the Peloponnesian War 5.18

[1] "The Athenians and Lacedaemonians and their confederates have made peace and sworn it, city by city, as followeth:

[2] "Touching the public temples, it shall be lawful to whomsoever will to sacrifice in them and to have access unto them and to ask counsel of the oracles in the same and to send their deputies unto them, according to the custom of his country, securely both by sea and land. "The whole place consecrate and temple of Apollo in Delphi, and Delphi itself, shall be governed by their own law, taxed by their own state, and judged by their own judges, both city and territory, according to the institution of the place.

[3] "The peace shall endure between the Athenians with their confederates and the Lacedaemonians with their confederates for fifty years, both by sea and land, without fraud and without harm-doing.

[4] "It shall not be lawful to bear arms with intention of hurt, neither for the Lacedaemonians and their confederates against the Athenians nor for the Athenians and their confederates against the Lacedaemonians by any art or machination whatsoever; if any controversy shall arise between them, the same shall be decided by law and by oath, in such manner as they shall agree on.

[5] "The Lacedaemonians and their confederates shall render Amphipolis to the Athenians; the inhabitants of whatsoever city the Lacedaemonians shall render unto the Athenians shall be at liberty to go forth whither they will with bag and baggage. "Those cities which paid the tribute taxed in the time of Aristides, continuing to pay it, shall be governed by their own laws. And now that the peace is concluded, it shall be unlawful for the Athenians or their confederates to bear arms against them or to do them any hurt as long as they shall pay the said tribute; the cities are these: Argilus, Stageirus, Acanthus, Scolus, Olynthus, Spartolus;

[6] and they shall be confederates of neither side, neither of the Lacedaemonians nor of the Athenians;

[7] but if the Athenians can persuade these cities unto it, then it shall be lawful for the Athenians to have them for confederates, having gotten their consent. "The Mecybernaeans, Sanaeans, and Singaeans shall inhabit their own cities on the same conditions with the Olynthians and Acanthians. "The Lacedaemonians and their confederates shall render Panactum unto the Athenians. "And the Athenians shall render to the Lacedaemonians Coryphasium, Cythera, Methone, Pteleum, and Atalante; they shall likewise deliver whatsoever Lacedaemonians are in the prison of Athens or in any prison of what place soever in the Athenian dominion, and dismiss all the Peloponnesians besieged in Scione and all that Brasidas did there put in, and whatsoever confederates of the Lacedaemonians are in prison, either at Athens or in the Athenian state. "And the Lacedaemonians and their confederates shall deliver whomsoever they have in their hands of the Athenians or their confederates in the same manner.

[8] "Touching the Scionaeans, Toronaeans, and Sermylians, and whatsoever other city belonging to the Athenians, the Athenians shall do with them what they think fit.

[9] "The Athenians shall take an oath to the Lacedaemonians and their confederates, city by city; and that oath shall be the greatest that in each city is in use. The thing that they shall swear shall be this: 'I stand to these articles and to this peace, truly and sincerely.' And the Lacedaemonians and their confederates shall take the same oath to the Athenians.

[10] This oath they shall on both sides every year renew and shall erect pillars [inscribed with this peace] at Olympia, Pythia, and in the Isthmus; at Athens, within the citadel; and at Lacedaemon, in the Amyclaeum.

[11] "And if anything be on either side forgotten, or shall be thought fit upon good deliberation to be changed, it shall be lawful for them to do it, in such manner as the Lacedaemonians and Athenians shall think fit, jointly.

[1] The Athenians and Lacedaemonians and their allies made a treaty, and swear to it, city by city, as follows:

[2] 1. Touching the national temples, there shall be a free passage by land and by sea to all who wish it, to sacrifice, travel, consult, and attend the oracle or games, according to the customs of their countries.
  2. The temple and shrine of Apollo at Delphi and the Delphians shall be governed by their own laws, taxed by their own state, and judged by their own judges, the land and the people, according to the custom of their country.

[3] 3. The treaty shall be binding for fifty years upon the Athenians and the allies of the Athenians, and upon the Lacedaemonians and the allies of the Lacedaemonians, without fraud or hurt by land or by sea.

[4] 4. It shall not be lawful to take up arms, with intent to do hurt, either for the Lacedaemonians and their allies against the Athenians and their allies, or for the Athenians and their allies against the Lacedaemonians and their allies, in any way or means whatsoever. But should any difference arise between them they are to have recourse to law and oaths, according as may be agreed between the parties.

[5] 5. The Lacedaemonians and their allies shall give back Amphipolis to the Athenians. Nevertheless, in the case of cities given up by the Lacedaemonians to the Athenians, the inhabitants shall be allowed to go where they please and to take their property with them; and the cities shall be independent, paying only the tribute of Aristides. And it shall not be lawful for the Athenians or their allies to carry on war against them after the treaty has been concluded, so long as the tribute is paid. The cities referred to are Argilus, Stagirus, Acanthus, Scolus, Olynthus , and Spartolus. These cities shall be neutral, allies neither of the Lacedaemonians nor of the Athenians; but if the cities consent, it shall be lawful for the Athenians to make them their allies, provided always that the cities wish it.

[6] The Mecybernaeans, Sanaeans and Singaeans shall inhabit their own cities, as also the Olynthians and Acanthians;

[7] but the Lacedaemonians and their allies shall give back Panactum to the Athenians.
  6. The Athenians shall give back Coryphasium, Cythera , Methana , Pteleum, and Atalanta to the Lacedaemonians, and also all Lacedaemonians that are in the prison at Athens or elsewhere in the Athenian dominions, and shall let go the Peloponnesians besieged in Scione , and all others in Scione that are allies of the Lacedaemonians, and all whom Brasidas sent in there, and any others of the allies of the Lacedaemonians that may be in the prison at Athens or elsewhere in the Athenian dominions.
  7. The Lacedaemonians and their allies shall in like manner give back any of the Athenians or their allies that they may have in their hands.

[8] 8. In the case of Scione , Torone , and Sermylium, and any other cities that the Athenians may have, the Athenians may adopt such measures as they please.

[9] 9. The Athenians shall take an oath to the Lacedaemonians and their allies, city by city. Every man shall swear by the most binding oath of his country, seventeen from each city. The oath shall be as follows:—‘I will abide by this agreement and treaty honestly and without deceit.’ In the same way an oath shall be taken by the Lacedaemonians and their allies to the Athenians;

[10] and the oath shall be renewed annually by both parties. Pillars shall be erected at Olympia , Pythia, the Isthmus, at Athens in the Acropolis, and at Lacedaemon in the temple at Amyclae.

[11] 10. If anything be forgotten, whatever it be, and on whatever point, it shall be consistent with their oath for both parties the Athenians and Lacedaemonians to alter it, according to their discretion.

„Was die gemeinsamen Heiligthümer betrifft, so mag opfern ¹

Argilos, Stagciros, Akanthos, Skolos, Olynthos, Spartolos.
so soll ihnen das erlaubt sein." ^{3 4}

beide Theile einigen, Athener und Lakedämonier." ^{6 7}

zur See.

bereichs in Kriegsgefangenschaft befinden.
Eid leisten.

[1] "The Athenians and the Lacedaemonians and their respective allies have concluded a treaty and sworn to it state by state upon the following terms:

[2]
  1. "With regard to the common sanctuaries, ¹ whoever wishes may offer sacrifices and consult the oracles and attend as a deputy according to the customs of the fathers, both by land and sea, without fear.
  2. "The precinct and the temple of Apollo at Delphi and the people of Delphi shall be independent, having their own system of taxation and their own courts of justice, both as regards themselves and their own territory, according to the customs of the fathers.
  3.

[3] "The truce shall be in force for fifty years between the Athenians and their allies and the Lacedaemonians and their allies, without fraud or hurt, both by land and sea.
  4.

[4] "It shall not be lawful to bear arms with harmful intent, either for the Lacedaemonians and their allies against the Athenians and their allies, or for the Athenians and their allies against the Lacedaemonians and their allies, by any art or device. And if there be any dispute with one another, they shall have recourse to courts and oaths, according as they shall agree.
  5. "The Lacedaemonians and their allies shall restore Amphipolis to the Athenians.

[5] But in the case of cities delivered by the Lacedaemonians to the Athenians, their inhabitants shall be allowed to go away wherever they wish, having their own possessions; and these cities, so long as they pay the tribute that was fixed in the time of Aristeides, shall be independent. And it shall not be lawful for the Athenians and their allies, after the ratification of the treaty, to bear arms against the cities to their hurt, so long as they pay the tribute. These cities are Argilus, ² Stagirus, ³ Acanthus, ⁴ Stolus, Olynthus, ⁵ Spartolus. ⁶ These shall be allies neither of the Lacedaemonians nor of the Athenians; but if the Athenians can persuade these cities it shall be lawful for the Athenians to make them, with their own free will and consent, allies to themselves.
  6.

[6] "The Mecybernaeans and Sanaeans ⁷ and Singians shall dwell in their own towns on the same terms as the Olynthians and Acanthians.
  7. "The Lacedaemonians and their allies shall restore Panactum ⁸ to the Athenians.

[7] The Athenians shall restore to the Lacedaemonians, Coryphasium, ⁹ Cythera, ¹⁰ Methana, ¹¹ Pteleum, and Atalante ¹² ; also they shall set at liberty the Lacedaemonian captives who are in the public prison at Athens or in public prison anywhere else that the Athenians hold sway, and the men of the Peloponnesus who are being besieged in Scione, and all besides who are allies of the Lacedaemonians in Scione, ¹³ and those whom Brasidas sent into the place, ¹⁴ as likewise any of the allies of the Lacedaemonians who are in the public prison in Athens, or in public prison anywhere else that the Athenians have sway. In like manner the Lacedaemonians and their allies shall restore whomsoever they have of the Athenians and their allies.
  8.

[8] "As to Scione, Torone, ¹⁵ Sermyle, or any other city which the Athenians hold, the Athenians shall determine about these and the other cities as they may think best.
  9. "The Athenians shall bind themselves by oaths with the Lacedaemonians and their allies, city by city;

[9] and either party shall swear its customary oath in the form that is most binding, ¹⁶ seventeen men representing each city. The oath shall be as follows: 'I will abide by this agreement and this treaty, justly and without deceit.' For the Lacedaemonians and their allies there shall be an oath, in the same terms, with the Athenians. And both parties shall renew the oath year by year.
  10.

[10] "They shall erect pillars at Olympia, Delphi, the Isthmus, and on the Acropolis at Athens, and at Lacedaemon in the temple of Apollo of Amyclae. ¹⁷
  11.

[11] "If either party forgets anything about any matter whatsoever, it shall be consistent with their oath for both, by means of fair discussion, to make a change at any point where it may seem good to both parties, the Athenians and the Lacedaemonians.

[1] 1st, "The Athenians and Lacedaemonians, with their allies, ¹ made a treaty on the following terms, and swore to observe it, state by state. With regard to the temples common to the nation, that whoever wishes shall sacrifice, and go for that purpose, and consult the oracle, and attend the games, according to the custom of his fathers, whether proceeding by sea or land, without fear.

[2] 2nd, "That the temple and shrine of Apollo at Delphi, and the Delphians, shall be independent, self-taxed, and self judged, as regards both themselves and their territory, according to their hereditary usage.

[3] 3rd, "That the treaty shall be in force fifty years between the Athenians and their allies, and the Lacedaemonians and theirs, without guile or wrong, by land and by sea.

[4] 4th, "That it shall not be lawful to take the field for the purpose of inflicting injury, either for the Lacedaemonians and their allies against the Athenians and their allies, or for the Athenians and their allies against the Lacedaemonians and their allies, by any means whatever. But should any dispute arise between them, they must have recourse to justice and oaths, in whatever way they may arrange.

[5] 5th, "That the Lacedaemonians and their allies shall restore Amphipolis to the Athenians. That of all the cities, however, which the Lacedaemonians may restore to the Athenians, the inhabitants shall be allowed to depart wherever they please, themselves and their property with them; and the cities shall be independent, only paying the tribute that was paid in the time of Aristides. That it shall not be lawful for the Athenians, or their allies, to take the field against them for their injury, after the treaty has been concluded. The cities referred to are Argilus, Stagirus, Acanthus, Scolus, Olynthus, and Spartolus. That these shall be considered as allies to neither party, neither the Lacedaemonians nor the Athenians; but if the Athenians gain the consent of the cities, then it shall be lawful for them to make them their allies, with their own free will. That the Mecybernaeans, Samaeans, and Singaeans shall inhabit their own cities, like the Olynthians and Acanthians; but that the Lacedaemonians and their allies shall restore Panactum to the Athenians.

[6] 6th, "That the Athenians, also, shall restore to the Lacedaemonians Coryphasium, Cythera, Methone, Pteleum, and Atalanta, and all the Lacedaemonians that are in prison at Athens, or any where else in all the Athenian dominions; and shall release those of the Peloponnesians who are being besieged in Scione; and all others in that place who are allies of the Lacedaemonians; and whoever amongst the allies of the Lacedaemonians is in prison at Athens, or any where else in the Athenian dominions.

[7] 7th, "That the Lacedaemonians too, and their allies, shall in the same way restore whomever of the Athenians and their allies they may have in their hands.

[8] 8th, "That in the case of the Scionaeans, Toronaeans, and Sermylians, and whatever other city the Athenians have possession of, respecting these and the rest they shall adopt such measures as they please.

[9] 9th, "That the Athenians shall take the oaths to the Lacedaemonians and their allies, state by state; and that every man shall swear by the most binding oath of his country, according to his respective state. That the oath must be to this effect: 'I will abide by these arrangements and articles of the treaty, honestly and without guile.' That in the same way an oath shall be taken by the Lacedaemonians and their allies to the Athenians;

[10] and that on both sides the oath shall be renewed yearly. That the contracting parties shall erect pillars at Olympia, Pythia, the Isthmus, at Athens in the citadel, and at Lacedaemon in ² the temple of Apollo at Amyclae.

[11] That if they forget any thing, whatever it may be, and on whatever point, it shall be consistent with their oaths for both parties, Athenians and Lacedaemonians, by means of fair discussion, to change it in such manner as they please.

[5] Lacedaemonii vero eorumque socii Amphipolin Atheniensibus reddant.

[7] Lace- daemonii vero eorumque socii Panacium Atheniensibus reddant.
