CXVIII. « Nous sommes d’accord¹ que chacun puisse, à son gré, user du temple et de l’oracle d’Apollon Pythien, sans dol et sans crainte, suivant les anciens usages. Les Lacédémoniens et leurs alliés présents admettent ce point ; ils s’engagent à envoyer un message aux Béotiens et aux Phocéens, et à obtenir, autant que possible, leur adhésion. Quant aux trésors du dieu, nous ferons nos efforts pour en découvrir les déprédateurs, conformément au droit, à la justice et aux anciens usages, vous, nous, et quiconque le voudra ; le tout conformément aux usages antiques.

« Les Lacédémoniens et leurs alliés admettent que, si les Athéniens veulent traiter, nous conserverons de part et d’autre ce que nous avons maintenant. Ceux qui sont à Coryphasium² resteront en deçà de Buphras et de Tomée³ ; à Cythère, on s’interdira réciproquement toute communication avec les alliés, nous avec les leurs, eux avec les nôtres. Ceux qui sont à Nisce et à Minoa⁴ ne dépasseront pas la route qui mène des portes de Nisus au temple de Neptune, et du temple de Neptune droit au pont de Minoa. Les Mégariens, de leur côté, et leurs alliés, ne dépasseront pas cette route ; les Athéniens garderont l’île qu’ils ont prise ; on ne pourra en aucune façon établir aucune communication les uns chez les autres.

« A Trézène, les choses resteront dans l’état actuel, sur le pied des conventions faites avec les Athéniens.

« Chacun aura l’usage des mers qui baignent ses côtes et celles de ses alliés. A l’exccption des vaisseaux longs⁵, les Lacédémoniens et leurs alliés pourront naviguer avec tout autre bâtiment à rames, jusqu’au port de cinq cents talents. Les hérauts, les ambassadeurs et leur suite, envoyés, en quelque nombre qu’il conviendra, pour terminer la guerre et les différends, soit dans le Péloponnèse, soit en Attique, voyageront sous la foi publique pour l’aller et le retour, par terre et par mer.

« Pendant ce temps, ni vous, ni nous, ne recevrons les transfuges, libres ou esclaves. Chacun de nous rendra justice à l’autre, suivant le droit établi ; les contestations seront réglées à l’amiable, sans recourir aux armes.

« Telles sont les bases admises par les Lacédémoniens et leurs alliés ; si vous avez quelque chose de mieux ou de plus juste à nous proposer, venez à Lacé- démone nous le faire connaître. Rien de ce que vous proposerez de juste ne sera repoussé ni par les Lacédémoniens, ni par les alliés. Que vos envoyés soient chargés de pleins pouvoirs, comme vous nous le demandez de votre côté.

« Le traité sera pour un an.

« — Adopté par le peuple⁶, sous la prytanie de la tribu Acamantide ; Phénippus, greffier ; Niciadès, épistate. Lachès prononça : Pour le bonheur des Athéniens ! il y a trêve sur les bases admises par les Lacédémoniens et leurs alliés. Il a été décidé dans rassemblée du peuple qu’il y aurait trêve pour un an, à dater de ce jour quatorze du mois élaphébolion. Pendant ce temps, des ambassadeurs et des hérauts seront envoyés de part et d’autre afin de s’entendre sur les moyens de terminer la guerre. Les stratèges et les prytanes convoqueront une assemblée où les Athéniens délibéreront d’abord sur la paix, toutes les fois qu’il viendra quelque ambassade à ce sujet ; aussitôt après, les ambassadeurs présents s’engageront devant le peuple à maintenir la trêve pendant l’année.

[3] That concerning the treasure belonging to the god, we shall take care to find out those that have offended therein, both we and you, proceeding with right and equity, according to the laws of our several states;

[4] and that whosoever else will may do the same every one according to the law of his own country. "If the Athenians will accord that each side shall keep within their own bounds, retaining what they now possess, the Lacedaemonians and the rest of the confederates touching the same think good thus: "That the Lacedaemonians in Coryphasium stay within the mountains of Buphras and Tomeus, and the Athenians in Cythera without joining together in any league, either we with them or they with us. That those in Nisaea and Minoa pass not the highway, which from the gate of Megara near the temple of Nisus leadeth to the temple of Neptune, and so straightforward to the bridge that lies over into Minoa; that the Megareans pass not the same highway, nor into the island which the Athenians have taken, neither having commerce with other. [8] "That you to us and we to you shall afford law according to the use of our several states, to the end our controversies may be decided judicially without war.

[3] 2. As to the treasure of the god, we agree to exert ourselves to detect all malversators, truly and honestly following the customs of our forefathers, we and you and all others willing to do so, all following the customs of our forefathers.

[4] As to these points the Lacedaemonians and the other allies are agreed as has been said. 3. As to what follows, the Lacedaemonians and the other allies agree, if the Athenians conclude a treaty, to remain, each of us in our own territory, retaining our respective acquisitions; the garrison in Coryphasium keeping within Buphras and Tomeus; that in Cythera attempting no communication with the Peloponnesian confederacy, neither we with them, or they with us; that in Nisaea and Minoa not crossing the road leading from the gates of the temple of Nisus to that of Poseidon and from thence straight to the bridge at Minoa ; the Megarians and the allies being equally bound not to cross this road, and the Athenians retaining the island they have taken, without any communication on either side; as to Troezen , each side retaining what it has, and as was arranged with the Athenians.

[5] 4. As to the use of the sea, so far as refers to their own coast and to that of their confederacy, that the Lacedaemonians and their allies may voyage upon it in any vessel rowed by oars and of not more than five hundred talents' tonnage, not a vessel of war.

[6] 5. That all heralds and embassies, with as many attendants as they please, for concluding the war and adjusting claims, shall have free passage, going and coming, to Peloponnese or Athens by land and by sea.

[7] 6. That during the truce, deserters whether bond or free shall be received neither by you, nor by us.

[8] 7. Further, that satisfaction shall be given by you to us and by us to you according to the public law of our several countries,

[9] all disputes being settled by law without recourse to hostilities. The Lacedaemonians and allies agree to these articles: but if you have anything fairer or juster to suggest, come to Lacedaemon and let us know; whatever shall be just will meet with no objection either from the Lacedaemonians or from the allies.

[11] The tribe of Acamantis had the prytany, Phoenippus was secretary, Niciades chairman. Laches moved, in the name of the good luck of the Athenians, that they should conclude the armistice upon the terms agreed upon by the Lacedaemonians and the allies.

[12] It was agreed accordingly in the popular assembly, that the armistice should be for one year, beginning that very day, the fourteenth of the month of Elaphebolion;

[13] during which time ambassadors and heralds should go and come between the two countries to discuss the bases of a pacification.

[14] That the generals and prytanes should call an assembly of the people, in which the Athenians should first consult on the peace, and on the mode in which the embassy for putting an end to the war should be admitted. That the embassy now present should at once take the engagement before the people to keep well and truly this truce for one year.

nöthig dünkt, zum Zwecke der Beendigung des Krieges und der
Rechtsentshceidungen, sowohl nach dem Peloponnes, als nach Athen,
soll freier Ab- und Zugang fein, sowohl, zu Land, als zu Wasser.
Ueberläuser sollen während dieser Zeit nicht angenommen werden, ²³
weder ein Freier, noch ein Sklave, weder von unserer, noch von eurer Seite⁴Rechtsentscbeidnngen aber sollt ihr sowohl uns, als wir euch >
gegenüber nach hergebrachter Weise obwalten lassen, so daß
Streitigkeiten nach dem Recht ohne Kampf entschieden werden.- Dieß ist's,
was die Lakedämonier und ihre:Bundesgenossen vorschlagen..Wenn
ihr aber etwas Besseres und Gerechteres wißt als dieß, so kommt nach
Lakedämon und theilt es mit; denn Nichts, was immer Gerechtes ihr
vorbringen möget, werden sie abweisen, weder die Lakedämonier, noch
ihre Bundesgenossen. Wer aber kommt-soll mit Vollmacht kommen,
wie auch ihr von uns verlangt. i Der Waffenstillstand soll aber ein

unter den Bedingungen, welche die Lakedämonier und ihre

„Anlangend den Tempel und das Orakel deS pythischen

Teile innerhalb der von ihnen besetzten Gebiete bleiben, die
Athener also einerseits bei Koryphasion bis Buphras und
Tomeus, anderseits auf Kythera, aber keinen Verkehr mit den
Bundesgenossen unterhalten, sie so wenig mit unseren wie wir
mit ihren; bei Nisaia und Minoa sollen sie die Straße, welche
vom Tore beim Nisostempel nach dem Poseidontempel und
von da grade auf die Brücke nach Minoa führt, nicht über
schreiten, - ebensowenig sollen die Megarer und ihre Bundes
genossen diese Straße überschreiten. Die von ihnen besetzte
Insel sollen die Athener behalten, jedoch unter Ausschluß jedes
Verkehrs zwischen hüben und drüben, und ebenso alles, was
sie im Gebiet von Troizen auf Grund der darüber zwischen
ihnen und den Troizenern getroffenen Vereinbarungen gegen
wärtig besitzen. Der Verkehr zur See innerhalb der eigenen
Gewässer und denen der Bundesgenossen soll unverwehrt, den
Lakedämoniern und ihren Bundesgenossen aber nicht gestattet
sein, die See mit Kriegsschiffen oder anderen Ruderfahrzeugen
von mehr als fünfhundert Talenten zu befahren. Herolde
und Gesandtschaften in Friedens- oder Rechtsangelegenheiten,
mit Gefolge nach Belieben, sollen nach dem Peloponnes und
nach Athen sowohl zu Lande wie zur See ungehindert hin
und her reisen dürfen. Überläufer sollen während dieser Zeit
nicht angenommen werden, weder Freie noch Sklaven, weder
von uns noch von euch. Rechtshändel unter uns sollen in
hergebrachter Weise vor Gericht ausgetragen, Streitigkeiten also
nicht mit den Waffen, sondern im Wege Rechtens entschieden
werden. Das sind die Vorschläge der Lakedämonier und ihrer
Bundesgenossen. Glaubt ihr, waS Besseres vorschlagen zu
können, so kommt nach Lakedämon und laßt es uns wissen.
Allen berechtigten Wünschen, die ihr etwa vorbringt, werden
sowohl wir Lakedämonier wie unsere Bundesgenossen gern
entgegenkommen. Laßt eure Abgesandten Vollmacht mitbringen,
wie ihr das ja auch von uns verlangt. Der Waffenstillstand
soll ein Jahr dauern.

Beschluß des Volks. Prytanie Akamantis. Schriftführer Phainippos. Vorsitzender Nikiades.

Laches beantragte, den Waffenstillstand auf Grund der von
den Lakedämoniern und ihren Bundesgenossen vorgeshclagenen
Bedingungen abzuschließen, den Athenern zum Heil.

Das Volk genehmigte den Abschluß des Waffenstillstandes auf
ein Jahr, zu beginnen vom heutigen Tage, dem vierzehnten
des Monats Elaphebolion. Unterdessen sollen Gesandte und
Herolde beider Teile zu Friedensverhandlungen zusammentreten,
die Feldherren und Prytanep aber eine Versammlung berufen,
um zunächst einen Beschluß der Athener über die den Gesandten
zu dem Ende zu erteilenden Instruktionen herbeizuführen. Die
anwesenden Gesandten sollen sich gleich vor dem Volke feierlich
verpflichten, den Waffenstillstand ein Jahr lang unverbrüchlich
zu halten."

Ceux de Niséa et de Minoa ne dépasseront pas la route qui va de la porte de Nisos³ au temple de Neptune et du temple de Neptune directement au pont de Minoa, les Mégariens et leurs alliés ne dépassant pas non plus ladite route ; les Athéniens conservant l’île qu’ils ont prise⁴, sans qu’il y ait aucune communication entre eux de part ni d’autre, conservant aussi ce qu’ils possèdent présentement à Trézène⁵, conformément à la convention intervenue avec les Athéniens.

« Chacun aura l’usage de la mer le long de son territoire et de celui de ses alliés, les Lacédémoniens et leurs alliés ne naviguant pas avec des vaisseaux longs, mais seulement avec des bâtiments à rames du port de cinq cents talents ⁶.

« Les hérauts, ambassadeurs et toutes personnes de leur suite , se rendant à Athènes ou dans le Péloponèse pour traiter de la paix ou pour régler des différends, iront et reviendront, par mer ou par terre, sous assurance de la foi publique.

« Il ne sera reçu pendant la durée de la trêve aucun transfuge, libre ou esclave, ni par vous ni par nous.

[11] Decreed by the people. The tribe Acamantis held the prytany, Phaenippus was clerk, Niciades was president.

[12] Laches, invoking good fortune for the people of Athens, moved to conclude the armistice according to the terms to which the Lacedaemonians and their allies had consented; and it was agreed in the popular assembly that the armistice should be for a year, and should begin on that day, the fourteenth of the month Elaphebolion.

[13] During this time envoys and heralds were to go from one state to the other and discuss proposals looking to the termination of the war.

[14] And the generals and prytanes were to call an assembly in which the Athenians should deliberate first of all about peace, on what terms the Lacedaemonian embassy for ending the war should be admitted. And the embassies now present should pledge themselves at once, in the presence of the people, to abide by the truce for the year.

"That any herald, ambassadors, and attendants, as many as they may choose, on their way to the Peloponnese or to Athens, for bringing the war to a conclusion, and adjusting all claims, shall have free passage, going and returning, both by

[7] land and by sea. That deserters shall not be received in the mean time, neither free nor bond, neither by

[8] you nor by us. Further, that we shall give judicial satisfaction, both you to us and we to you, according to the laws of our respective countries, deciding all disputes by law,

The Lacedaemonians and allies agree to these articles: but if you think any thing else either better or more just, come to Lacedaemon and explain your views; for neither the Lacedaemonians nor the allies will object to any thing you may say with justice. The people [of Athens] ratified the truce.

The tribe Acamantis had ¹ the prytany; Phoenippus was secretary; Niciades was chairman. Laches moved, 'that they do conclude the armistice, (and may they do it for the good fortune of Athens!) on the terms agreed to

by the Lacedaemonians and the allies.' And they agreed in the assembly of the people, 'that the armistice be for a year, commencing this very day, the

fourteenth of the month of Elaphebolion; that, during that time, ambassadors and heralds shall proceed to each other's country, and discuss on what terms the war

shall be brought to a conclusion. That the generals and prytanes having summoned an assembly of the people, the Athenians shall, in the first place, consult on the peace, and on the manner in which the envoys for putting an end to the wars shall be admitted. 1. Il suffit de lire ce traité pour se convaincre que les clauses en furent d’abord réglées à Lacédémone, et ensuite portées à Athènes pour la ratification. Toute la première partie, jusqu’aux mots « adopté par le peuple, » contient les propositions des Lacédémoniens ; vient ensuite la ratification à Athènes, et enfin l’approbation donnée par les députés lacédémoniens au traité, tel qu’il avait été ratifié.
